Article 1. Fields of application
The General Conditions of Sale below are intended to govern all contractual relations between A.Hair and customers placing an order via the site www.ahairproducts.com
The purpose of these general conditions of sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales on the AHair brand website.
Any order placed through the site by the buyer implies his unreserved acceptance of the GCS. To this end, the buyer confirms that he accepts all of the T&Cs and that he has read them when he ticks the “I accept” box when placing his order.
AHair reserves the right to modify these T&Cs at any time for the future. It is the buyer’s responsibility to carefully read the T&Cs applicable at the time to each new order. The T&Cs applicable to the order are those accepted by the buyer when placing the order.
The current GCS are accessible at any time on the site and prevail over any other previous version or any other contradictory document.
Article 2. Process of an order
The process below describes the process for ordering the product(s) selected para.
The identification of the buyer:
The identification of the buyer can be carried out directly after the selection of the Products or via his AHair customer account.
The opening of an account includes the entry of information by the buyer, in particular a valid e-mail address and a password. These identifiers are personal to the buyer and must be kept confidential by the latter.
The buyer accesses the site and can add the products he wishes to order in his basket. He then has access to the contents of his basket including all the products he has added. The buyer will then have to proceed to his identification. In this context, the buyer undertakes to provide reliable and accurate information. AHair cannot be held liable in the event that the information provided by the buyer turns out to be totally or partially false and/or incomplete.
In this situation or in the event of non-payment or any other irregularity on the buyer’s account, AHair reserves the right to proceed with the cancellation of the order and/or to delete the buyer’s user account.
The identification of the sender of the products:
The products sold on the site are sold by AHair in its name and on its behalf.
Placement of the order by the buyer:
After the buyer has placed the products he wishes to order in the basket and has entered his identification data, a summary of the order is then presented to the buyer, allowing him to check the details of his order and to correct any errors.
A product packaging service can be offered free of charge. The products will be slipped into a box. Products in the same order cannot be individually wrapped. The packaging will be chosen according to the size of the products present in the package.
The Buyer will have to inform and verify the billing and delivery address, then proceed to the choice of his method of delivery and payment. An order number will be assigned to the buyer as soon as he has paid for his order.
Final order confirmation:
Only confirmation of payment definitively validates the order and contractually commits AHair vis-à-vis the buyer. The invoice will be available on the AHair customer account.
The buyer will be debited for the amount of his order at the time of sending the latter (except in the case of payment by Paypal account where the debit will be immediate from the placing of the order) or at the latest within 7 days following the confirmation of the order on the site.
Product features and availability:
Prior to his order, the buyer can read the essential characteristics of the product(s) he wishes to order on the various product sections of the site.
Furthermore, any order that seems abnormal, in particular because of its amount, volume or frequency, may be suspended and may, if necessary, justify the suspension and/or closure of the customer account.
AHair reserves the right to modify at any time the assortment of products offered for sale on its site.
Article 3. Prices
The selling prices of the products offered on the site are indicated in euros and “All Taxes Included” (TTC). The selling prices of the products on the site are those
in force at the time of placing the order by the buyer.
Prices do not include shipping costs, invoiced in addition to the price of the products purchased. Shipping costs are indicated before the confirmation of the order by the buyer.
Article 4. Payment
The buyer assures AHair that he holds the necessary authorizations to use the method of payment he has chosen to pay for his order, when registering the latter.
The buyer is offered several means of payment on the site which may vary depending on the products ordered, current offers or the delivery method chosen.
4.1 Means of payment accepted on www.ahairproducts.com
4.1.1. Bank Cards: The following cards are accepted: CB, VISA, EUROCARD/MASTERCARD or AMERICAN EXPRESS (with the exception of those issued from Argentina, Chile, South Korea, Croatia, Finland, Hong Kong, India, Japan, Kazakhstan, Macau, Malaysia, Norway, Peru, Philippines, Singapore, Sweden and Taiwan). All data entered during payment by credit card is immediately encrypted using the SSL protocol and stored on the BNP Paribas server. No confidential payment data is stored by AHair. This information is only accessible to our banking partner. At no time does AHair have access to the buyer’s bank details.
4.1.3. PayPal: This possibility implies the possession of a PayPal account by the buyer. The buyer will then be redirected to a secure PayPal page.
The buyer will have to enter the e-mail address linked to his PayPal account and his PayPal password when paying for the order. Financial and personal information is encrypted automatically when sending any sensitive information to PayPal servers. In the case of an item return, the refund will be made in the form of a credit to the PayPal account used for the payment of the original order.
4.2. Payment terms
Orders are payable in euros, including tax and mandatory contributions and delivery costs. The buyer will bear any bank charges (including in the case of a refund).
In the event of non-payment or partial payment of any sum due by the buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the site, including the occasion of prior orders; AHair reserves the right to suspend or cancel any execution of an order and/or delivery, whatever its nature and level of execution.
4.3. Security of payment transactions
As part of the fight against internet fraud, information relating to the purchaser’s order may be transmitted to any third party authorized by law or designated by AHair for the sole purpose of verifying the identity of the purchaser, the validity of the order, the method of payment used and the delivery envisaged.
In order to fight against identity theft and attempted bank card fraud on the site, NFD uses the services of the company Hipay, registered with the RCS of Nanterre under number 390 334 225 00096. NFD thus sends it all the information that the Buyer provided when ordering until payment. Hipay is responsible for detecting anomalies.
AHair reserves the right to proceed with the cancellation of the order if the checks carried out should reveal the provision of inaccurate or fraudulent data, in particular those relating to the history of the customer account, the IP and/or the country from which the order is placed, or other elements specific to our algorithms or those of Hipay.
Article 5. Delivery and receipt
5.1. General informations
The products ordered by the buyer will be delivered to the delivery address indicated by the Buyer when ordering (“Delivery address”). The delivery of the order is possible exclusively in metropolitan France, Corsica and Monaco. Deliveries cannot be made on Sundays and public holidays.
The delivery will take place within the time indicated on the order confirmation that AHair will have sent to the buyer. Delivery times run from the date of final validation of the order.
AHair undertakes to implement all the means necessary to respect the delivery times indicated. In the event of elements beyond the control of AHair (in particular bad weather, periods of strong influence on the site or force majeure), delivery times may be extended. In the event that AHair is informed of a delay in delivery, AHair undertakes to notify the Buyer as soon as possible.

In order to facilitate delivery, the email address and telephone number provided by the buyer may be affixed to the label on the package to be delivered.
The affixing of this information is intended to facilitate delivery, and in particular to allow the carrier to contact the buyer.
5.2. Delivery methods
5.2.1. Home deliveries: Tracked Colissimo / Chronopost / Private package:
For delivery by Colissimo or Chronopost, the package is delivered to the home and delivered to the recipient of the order. The recipient of the order is invited to sign the receipt given on delivery. This signed receipt is proof of delivery by AHair, and receipt by the recipient of the order, of the products ordered.
In the event of absence on the day of delivery, the recipient receives a notice of passage to be presented at the place indicated in this notice of passage, provided with a valid identity document in order to withdraw the parcel and this, within a minimum delay. 7 days and sometimes up to fifteen days.
In the event that the recipient is unable to collect the package within the time indicated on the delivery notice, the package is returned to AHair. In this case, the buyer will be refunded the amount of the order excluding delivery costs, by any means, at AHair’s choice, as soon as the package has been received by AHair.
5.2.3. Delivery to a relay point: Mondial Relais / Chrono Relais:
Delivery to a relay point allows the Buyer to have his parcel delivered to the relay point he has selected when ordering.
The buyer receives an e-mail informing him of the availability of his order at the desired collection point. The buyer has a period of 10 days to withdraw his package upon receipt of the email.
In order to withdraw his parcel, the buyer must present the aforementioned e-mail and his valid identity document.
In the event of withdrawal by a third party, the latter must be provided with a valid identity document, a copy of the identity document of the recipient of the order as well as the order number.
After 10 days, the package will be returned to AHair. The buyer will then be refunded the amount of his order, excluding delivery costs.
5.3. Receipt of order
Upon receipt of his package, the buyer is invited to check the condition and contents of the package, and to sign the delivery receipt with any reservations observed.
The signature on the receipt must match the recipient’s signature. Any verification may be carried out by AHair in case of doubt.
In the event of major anomalies relating to the condition of the package (heavily damaged package, open package, trace of a leak, etc.) or to the products ordered (missing products and/or damaged products), the recipient of the order must imperatively follow the procedure described below, which corresponds to the conditions of the order, within 3 days of receipt. Failure to comply with the appropriate procedure excludes any recourse against the carrier and AHair. Furthermore, the buyer cannot claim any refund. The buyer or the recipient of the order cannot also claim that AHair delivers the ordered products.
The buyer is invited to follow the correct delivery of his parcel via the parcel tracking service.
5.4 Procedures in case of damaged package, missing product or damaged product
The recipient must check the condition of the package, as well as the number, references and condition of the products delivered.
In the event of a problem, the recipient will make reservations in the carrier’s delivery note.
The recipient undertakes to make the report as soon as possible, but in any event within 3 days of delivery, to AHair Customer Service.

AHair Customer Service will process your return request and, if necessary, may request any additional information, and/or carry out any necessary verification.
Article 6. Withdrawals, refunds and returns,
6.1. Right of withdrawal / “Satisfied or Refunded” offer
In accordance with article L221-18, and following of the consumer code, the buyer can exercise his right of withdrawal without motivation
reasons from the receipt of his order, or the provision of it.
In accordance with Article L221-28 of the Consumer Code, the buyer may not exercise his right of withdrawal for certain products and in particular for:
– Goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
Subject to compliance with these conditions in terms of time, condition of the products and terms of return of the products, the buyer will obtain a refund of the returned products and, where applicable, the related delivery costs. In accordance with article L221-24 of the consumer code. AHair undertakes to reimburse the buyer according to the method of payment used for the initial transaction or any other means after the buyer’s agreement.
– Modalities for exercising the right of withdrawal
Terms common to all return methods
The buyer may only exercise his right of withdrawal upon receipt of his order.
The product(s) for which the buyer wishes to exercise his right of withdrawal must be delivered and/or returned in a condition suitable for new marketing (products in perfect condition, in their original packaging, unused or damaged, accompanied by accessories, samples, instructions, etc.).
If the buyer has benefited from an offer against purchase on the site, entitling him, under conditions, to one or more product(s) offered in return for his order and, as a result of the exercise of his right of withdrawal, he is no longer eligible for the offer in question; the buyer must then send the product(s) he wishes to return accompanied by the product(s) offered received in return for the order of the product(s) returned.
The responsibility of the buyer may be engaged in the event of depreciation of the product resulting from manipulations other than those necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.
AHair undertakes, subject to compliance with the conditions mentioned above, to reimburse the buyer as soon as the products are recovered.
If the Buyer’s order includes delivery costs, the buyer is invited to make his return using the procedure relating to returns made by post.
Returns made by post
In this context, it is recalled that the costs of returning the product(s) and the risks inherent in the return of the products are the responsibility of the Buyer.
Also, the Buyer must inform AHair of his wish to withdraw within 14 days of receipt of the Order, by the means made available to him:

A return form will be sent by AHair to the buyer.
The buyer agrees to return the products concerned to the address indicated on the Withdrawal Form (address below) and this within a maximum period of 14 days from the date on which the buyer informed AHair of his desire to retract. Returns sent after this time will not be accepted.

The products must also be accompanied by the return form, a copy of the withdrawal form duly completed or, failing that, must be accompanied by any document referring to the number of the initial order.
Article 7. Legal guarantees
7.1. Legal guarantee of conformity
In the event of a lack of conformity, the buyer will have the choice between repairing and replacing the product. In the event that the buyer’s choice entails a manifestly disproportionate cost compared to the other method proposed, taking into account the value of the good or the importance of the defect; AHair reserves the right not to proceed according to the choice of the buyer.
If none of the solutions envisaged can be implemented within one month of the complaint, the buyer has the option of requesting a reduction in the price or a refund. In the event that the lack of conformity is minor, the buyer will not be able to benefit from reimbursement.

Article 9. Retention of title
AHair retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included. Failure to pay may result in claims for the products.
The transfer of the risks of loss or deterioration is made in the hands of the buyer from the delivery of the products.
Article 10. Intellectual property right
The site and all its
elements therein (trademark, designs, logos, models, etc.) are either the exclusive property of AHair, or AHair holds the rights. Any total or partial reproduction is prohibited.
Article 11. Personal Data
AHair attaches great importance to the protection and respect of the privacy of its customers and their personal data.
Add a section on the protection of personal data? Does it show reliability and security for the buyer?
The buyer’s personal data collected and stored by AHair in the context of any order is intended for the proper management of orders, deliveries and invoices.
AHair reserves the right to use the data transmitted by the buyer for commercial purposes if the latter accepts it when registering on the Site by ticking the following information: “I wish to receive offers from A.Hair » . Otherwise, the buyer waives it.
Article 12. Liability
13.1. Limitation of Liability
AHair cannot be held liable when the buyer does not comply, in whole or in part, with the General Conditions of Sale.
AHair DISCLAIMS ALL RESPONSIBILITY FOR DIRECT AND/OR INDIRECT DAMAGES, WHETHER FORESEEABLE OR NOT, CAUSED BY USING THE SITE.
Likewise, we make no warranty with regard to the use of this website; it is the responsibility of each user to ensure that their devices are protected against viruses or any other external factors.
13.2. Buyer Capacity
The buyer declares to have full legal capacity, allowing him to engage under these General Conditions of Sale. AHair can under no circumstances be required to verify the capacity of visitors and buyers on its site.
If a buyer who does not have the legal capacity is required to order products on the AHair site, his legal representatives will have to assume full responsibility for the order and must in particular honor the price of the latter.
Article 13. Applicable law and competent jurisdiction
14.1. Applicable law
These General Conditions of Sale are subject to French law. ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, EXECUTION OR TERMINATION OF THE CONTRACT CONCLUDED BETWEEN AHAIR AND THE BUYER, EVEN IN THE EVENT OF MULTIPLE DEFENDANTS, WILL BE, IN THE ABSENCE OF AMICABLE AGREEMENT, THE EXCLUSIVE JURISDICTION OF THE COMPETENT FRENCH COURTS IN APPLICATION OF THE RULES LAID DOWN BY THE FRENCH CODE OF CIVIL PROCEDURE.
